Procedure to register a public guarantee fund in the corresponding registry of the BCRA.

What is it?

This is the procedure through which the national, provincial or Autonomous City of Buenos Aires funds interested in having the guarantees granted by them for financing from financial institutions be granted preferential status, in accordance with the Ordinance on Public Guarantee Funds, are registered in the pertinent registry.

To national, provincial or Autonomous City of Buenos Aires funds wishing to be registered in the Registry of Public Guarantee Funds.

Submit the documentation through the BCRA’s Front Desk, according to the instructions for submitting notes to the Front Desk.

What is needed?

In accordance with the Ordinance on Public Guarantee Funds, the following must be submitted:

 

Fund data

  • – Contact information.
  • – General data.
  • – Legal address.
  • – Registered office.

Data of legal entities related to the fund

  • – List of contributors or members of the fund, detailing the percentage of participation.
  • – List of the members of the administrative and control bodies.

    Documentation

    • – Note signed by the legal representative, stating the intention to register in the Registry of Public Guarantee Funds.
    • – Rule that provided for the creation of the fund.
    • – Photocopy certified by notary public of the guarantee fund bylaws.
    • – Latest financial or accounting statements -as applicable- certified by a public accountant.
    • – Information on the available risk fund, certified before a notary public, detailing: guarantees granted to customers, indicating the name of the company, taxpayer identification code (CUIT) and amount; species in which the funds are invested and financial institutions in which the corresponding investments are held in custody.

    How is it done?

    1 | Gather information and documentation

    Compile the fund data, the list of contributors and members of administrative and control bodies, and the required documentation.

    2 | Submit the application through the Intake Desk

    a) Draw up a note signed by the legal representative expressing the intention to register.
    b) Enclose the creation regulations, bylaws, financial statements and certified information on the available risk fund.
    c) Submit the application through the Intake Desk, according to the instructions in force.

    3 | Address the BCRA’s observations

    a) The documentation is reviewed for validation.
    b) In case of formal faults or requirements, corrections or clarifications shall be requested.
    c) All notices are sent to the email address declared by the fund.

    4 | Receive confirmation of registration

    Once the requirements have been met, the SEFyC notifies the registration and grants a number in the Registry of Public Guarantee Funds.
