Generate the Personal Background Form (FAP) through the APAEF application.
Procedure to upload personal background information and declaration of assets through the APAEF application, to be used in other procedures before the Central Bank of Argentina (BCRA).
What is it?
It is the procedure that allows the generation of the Personal Background Form (FAP) through the application “Personal Background of authorities of financial institutions and Evaluation of authorities (APAEF)”, for:
* Authorities covered by the text on “Authorities of financial institutions“,
* Representatives of foreign financial institutions not authorized to operate in the country, and
* Individuals included in items 2.4.8 and 5.2.4.2 of the text on “Authorization and capital composition of financial institutions“, who must submit personal background information, declaration of assets and sworn statements.
Who is it for?
Individuals who must file personal background information and asset declarations with the BCRA, in particular:
* authorities of financial institutions,
* representatives of foreign financial institutions not authorized to operate in the country,
* shareholder individuals or other persons covered by the Ordered Text on “Authorization and Capital Composition of Financial Institutions”.
Modality
Online processing, through the website of the Customs Collection and Control Agency (ARCA), using the service:
“BCRA – Personal background of authorities of financial institutions and Evaluation of authorities (APAEF)”.
Value of the procedure
Free procedure.
What is needed?
To generate the Personal Antecedents Formula (FAP) is required:
* Have a Fiscal Code level 3.
* Access the ARCA website and have enabled the service “BCRA – Personal background of authorities of financial institutions and Evaluation of authorities (APAEF)”.
* Have the personal, patrimonial and fiscal information necessary to complete:
- * personal background, and
* declaration of assets.
For the Goods Manifestation* that integrates the FAP, the provisions of Section A.2 of the Annex to Communication A 4499 must be considered:
* Complete the declaration of assets based on the information provided to the tax authority (ARCA) in the annual income tax and personal income tax returns.
* In the case of residents abroad, adjust the information to that submitted to the tax control body of the place of residence, expressed in local currency.
In the cases foreseen in the ordered text on “Authorization and composition of the capital of financial institutions“, the manifestations of assets must correspond:
* to the month immediately preceding the month in which the application for authorization or the share negotiation or capital contribution was filed (second column), and
* to the last fiscal period closed (first column).
How is it done?
Enter the APAEF application.
* Enter with Fiscal Code level 3 to the web site of the Agencia de Recaudación y Control Aduanero (ARCA).
* Register the service:
“BCRA – Personal background of authorities of financial institutions and Evaluation of authorities (APAEF)”.
* Access the corresponding filing module in the APAEF application.
In the case of a foreign authority or person who does not have a taxpayer identification code (CUIL), any person at the financial institution can upload that person’s data and generate the FAP.
2. Complete personal background and declaration of assets
* Upload in the APAEF application the required information on personal background.
* Complete the Manifestation of Assets, following the criteria indicated by the regulations (data consistent with the tax returns and, when applicable, with the month immediately prior to the request or share negotiation and the last fiscal period closed).
* Verify that all fields are complete and without inconsistencies.
Generate and download documentation
Once the information has been uploaded to the APAEF application:
* Generate the Personal Antecedents Formula (FAP).
* Generate the individual FAP Affidavit.
* Generate and download the validation voucher issued by the system.
* Download the documentation for later submission.
* Sign the individual FAP Affidavit and certify the signature before a notary public, as appropriate.
4. Use the documentation in other procedures
With the FAP, the FAP Individual Affidavit and the validation voucher, complete the corresponding sections in the procedures that require it, among others:
Request authorization to operate as a financial institution.
Request evaluation of authorities of financial institutions.
Request merger or transfer of goodwill of financial institutions.
Report a modification in the shareholding composition and control structure.
Request transformation of class of financial institutions.
Request authorization, change of name, change of domicile, replacement or revocation of representatives of foreign financial institutions not authorized to operate in the country.
